Terms of Service

Timeline + Shipping Policy

Commissions and custom orders ship USPS Priority Mail after the order processing time completes. Order processing time ranges between 3-8 business weeks. If the timeline is estimated to exceed 8 weeks, commissions close until they can be delivered in line with the estimated processing range. Processing time does not start until 3 high quality images are submitted via hi@estellahannah.com or within Etsy messages.

Art Prints and paper goods ship based on buyers choice between USPS First Class Mail or USPS Priority Mail. Art Prints are professionally produced using archival inks with a 2-5 business day processing time. Paper goods (non custom) ship within 1-2 days of order date unless the item is a pre-sale, then it will ship upon the announced shipment date.

Refund Policy

Refunds are only issued on prints returned without damage and within 30 days if purchased on instagram or facebook. A restocking fee may apply.

Commissions / custom works are non refundable though if you have an issue with your order, we will do everything we possibly can to make it right within reason. 

EstellaHannah is not held responsible for items lost in shipping but will make a reasonable attempt to solve. When shipping service is able to trace verify location and time of delivery are accurate with proof of delivery document through a Trace Case and Open Claim, EH will not provide a replacement. Signature and insurance is required on all shipments over $195. Insurance is not received by EH when the trace confirms accurate delivery. 

License & Use Policy

Plan on using an EstellaHannah for your wedding invites or to create merchandise for your business? We have several licenses to consider to make the decision an easy one!

Personal Use

If you do not plan on selling the finished product which incorporates EstellaHannah works, like a wedding invite or save the date, simply contact us about purchasing a digital file for personal use at hi@estellahannah.com or shop digital files for personal use directly on Etsy here.

Commercial Use

If you plan on selling a finished product which incorporates EstellaHannah works, request a Digital File for Commercial Use (up to 500 units sold) or for volumes where art is incorporated on over 500 units entities are to pay 10% of gross sales on a monthly basis. A separate commercial license is required per portrait per product.

The commercial use license allows my artwork to be used for multiple projects for sale for up to approved volume of sold units. Graphics must be used in a new design, and cannot be used as is if sold digitally. Digital items cannot be sold with my art as extractible or editable. This does not cover graphic design fees for EstellaHannah to create products, labels, paper goods that incorporate the design for you to sell.

If you do not take this action, you will be invoiced for an estimated forecast of sales by EstellaHannah on the 1st of every month.

All sales use cases must be written, submitted to and approved for use by the artist and owner Hannah at EstellaHannah. 

Whole Sale Art Prints 

EstellaHannah no longer supports a commission structure on Art Prints or Posters for wholesale and has migrated to a wholesale model where merchants must purchase through Faire.com. Merchants who still have legacy commission based prints will be invoiced for the wholesale rate to retain inventory.

COMMERCIAL LICENSE AGREEMENT

This agreement is a contract between ESTELLAHANNAH (”Designer”) and the purchaser (”Customer”) for Customer to make use of a single ESTELLAHANNAH product, subject to the terms and conditions below:

1. General Provisions.

(A) Designer owns all proprietary rights in and to the selected ESTELLAHANNAH product , and hereinafter collectively known as the “Work”, and has the exclusive right to license to others the right to produce, copy, make, sublicense or sell the Work.

(B) Designer owns all rights in and to the Work and retains all rights to the Work, which are not transferred herein, and retains all common law copyrights.

2. Permitted Uses.

Subject to the Prohibited Uses in Section 4 below, Designer hereby grants Customer a perpetual, non-exclusive, non-transferable, non-sublicensable, and worldwide right to:

• use the Work for multiple commercial projects as 10% fee of gross sales (respective to the type of commercial license purchased)
• use the Work while providing credit where possible
• use the Work for an unlimited number of physical items intended for sale up to quantities agreed upon
• use the Work for an unlimited number of digital products offered for sale up to quantities agreed upon

3. Prohibited Uses.

Prohibited Uses. Customer may not:

• resell the selected product (the standalone digital file or original painting or original print of the "Work")
• claim the selected product as their own
• share the files with third parties or offer them in a giveaway or promotion
• use this license to cover more than the agreed upon units sold

4. Designer’s Right to Authorship Credit.

Designer and Customer agree that when asked, Customer must properly identify ESTELLAHANNAH as the creator of Work. Customer does not have a proactive duty to display Designer’s name together with Work, but Customer may not seek to mislead others that Work was created by anyone other than Designer.

Failure to pay will result in written warning and after a reasonable attempt to collect, ESTELLAHANNAH will take legal action and merchant will be responsible for legal fees accrued.
